1. Eligibility Requirements:

  • You must be at least 18 years old to use Qismati.
  • You cannot use Qismati if you have been banned from the platform or if you have a history of hate crimes, terrorism, violence, or sexual offenses.
  • Qismati is designed for personal, non-commercial use only. Any use of the platform for business, advertising, or solicitation is prohibited.
  • You are responsible for keeping your account information accurate and up to date, including your contact information.
  • You cannot create an account on Qismati for another person. Each user must create their own individual account.

2. Purchases and Subscriptions:

  • Qismati offers both free and paid features, including premium subscriptions.
  • In-app purchases can be made using various payment methods accepted by Qismati, including credit cards, debit cards, and mobile payments.
  • All subscriptions are set to automatically renew unless cancelled before the end of the subscription period.
  • You may cancel your subscription at any time, but you will not be eligible for a refund for the current subscription period once it has started.
  • If you cancel a subscription, you will retain access to premium features until the end of the current billing cycle.

3. User Content and Responsibilities:

  • Users on Qismati can post various types of content, including text, photos, and emails.
  • You are solely responsible for any content you post or share on Qismati, including ensuring that it complies with the Community Rules.
  • By sharing content on Qismati, you grant Qismati a non-exclusive, royalty-free license to use, display, and distribute your content across its platform.
  • Qismati reserves the right to remove any content that it deems to be in violation of its Community Rules or applicable laws.
  • Content that violates the privacy or intellectual property rights of others is strictly prohibited.

4. Community Rules:

Qismati's Community Rules are in place to ensure a respectful and safe environment for all users. Violations of these rules may result in suspension or permanent banning from the platform. Prohibited behaviors include:

  • Posting offensive, obscene, or unlawful content
  • Harassing or abusing other users
  • Sharing spam, fraudulent information, or unsolicited communications
  • Impersonating another person or entity
  • Exploiting, abusing, or endangering children
  • Sharing content that violates others' privacy or confidentiality

5. Your Rights as a User:

  • You have the right to report any content or user behavior that you believe violates the Qismati Community Rules. Reports will be reviewed by Qismati's moderation team.
  • You can view, download, and print content from Qismati for personal, non-commercial purposes only.
  • If your content is removed by Qismati, you will be notified with an explanation for the removal, except in cases where legal obligations require otherwise.
  • You have the right to delete your account at any time, though certain information may be retained as required by law or for legitimate business purposes.
  • You have the right to access, correct, or update your personal information through your account settings.

6. Qismati's Rights:

  • Qismati retains all intellectual property rights related to the platform and its content, including logos, software, and proprietary designs.
  • You may not modify, reproduce, or distribute any content owned by Qismati without explicit permission.
  • Qismati reserves the right to update its platform, fix bugs, and make changes that comply with legal obligations or improve the user experience.
  • Significant changes to Qismati's features or functionality will be communicated to users in advance when possible.
  • Qismati may, at any time, stop offering certain features or discontinue the platform as a whole.

7. Modifications to Qismati:

  • Qismati reserves the right to modify its content and features at any time, without prior notice, to enhance the user experience.
  • Updates to the platform may include bug fixes, improvements to functionality, or compliance with new laws and regulations.
  • Significant changes, such as the introduction of new services, features, or pricing models, will be communicated to users in advance whenever possible.
  • Qismati may stop offering any service or product at any time without liability to users.
  • Users will be notified if their data is affected by changes, and the opportunity to access or delete personal information will be provided.

8. Your Responsibilities as a User:

  • You are responsible for your interactions with other users on Qismati, and you must exercise caution in sharing personal information.
  • If you encounter suspicious or inappropriate behavior from other users, you must report it to Qismati's moderation team for review.
  • You may close your account at any time through the app's account settings.
  • Upon closing your account, you may request a copy of your data, which will be available for download within 30 days.
  • Once an account is closed, Qismati will delete personal data according to its data retention policies, unless required to retain it for legal purposes.

9. Dispute Resolution in United States:

  • If you are located in the United States, any dispute arising from or related to Qismati's Terms of Use will be resolved through binding arbitration.
  • Arbitration will take place in a location agreed upon by both parties, or, if no agreement can be reached, it will be determined by Qismati.
  • You and Qismati waive the right to a trial by jury, and both parties waive the right to bring or participate in any class action lawsuits.
  • If you wish to opt out of the arbitration agreement, you must do so within 30 days of accepting the Terms of Use by notifying Qismati in writing.
  • Small claims court cases are exempt from the arbitration requirement, allowing you to seek resolution for qualifying disputes in small claims court.

10. Limitation of Liability:

  • Qismati is not liable for any indirect, incidental, or consequential damages arising from the use of the platform, including but not limited to loss of data, profits, or business opportunities.
  • Qismati does not guarantee that the platform will be available at all times or that it will be free from technical issues.
  • Users are responsible for ensuring their devices are compatible with Qismati's services and for maintaining up-to-date security software to protect their accounts from unauthorized access.
  • The maximum liability of Qismati to any user shall not exceed the amount paid by the user to Qismati in the twelve months preceding the claim.
  • These limitations apply to all claims, regardless of the legal theory under which they are brought.

11. Privacy Policy:

  • Qismati is committed to protecting the privacy of its users and has outlined its data practices in its Privacy Policy.
  • By using Qismati, you consent to the collection and use of your data as described in the Privacy Policy, which includes sharing data with third-party partners for operational purposes.
  • Users have the right to access, correct, or delete their personal information at any time through the app's privacy settings.
  • Qismati will not sell your personal data to third parties for marketing purposes without your explicit consent.

12. General Terms:

  • These Terms of Use constitute the entire agreement between you and Qismati concerning your use of the platform.
  • If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • These Terms are governed by the laws of Africa, and any legal action related to the platform will be subject to the jurisdiction of the courts in Africa.
  • If Qismati fails to enforce any provision of these Terms, it does not constitute a waiver of that provision.
  • These Terms may be updated from time to time, and continued use of the platform constitutes acceptance of any changes.
